Terms of Service

These Terms of Service (the “Terms”) govern your use of the niujom platform, operated by ClearCore Labs (“niujom”, “we”, “us”). By using niujom you accept these Terms. If you disagree with any part, please do not use the service.

1. What niujom is

niujom is a marketplace that connects people interested in properties in Venezuela with real estate agents, agencies, and owners. niujom is not a real estate broker, does not represent the parties, and is not a party to transactions between users. We do not provide legal, financial, tax, or investment advice.

2. Acceptance and eligibility

  • You must be at least 18 years old and have legal capacity to contract to use niujom.
  • By creating an account you confirm that the information you provide is true, complete, and current.
  • One person, one account. Duplicate accounts and identity impersonation are not allowed.

3. Your account

  • You are responsible for keeping your password confidential and for all activity under your account.
  • Notify us immediately if you detect unauthorized use.
  • We may suspend or close accounts that breach these Terms, contain false information, or show abusive behavior.

4. Property listings

If you list properties on niujom, you agree that:

  • The information is truthful and up to date (price, location, characteristics, availability).
  • Photos and descriptions are your own or you have the right to use them.
  • The price is listed in USD and reflects the real value of the offer.
  • The property actually exists and is not a duplicate of another listing.
  • You will not post duplicate, fictitious, misleading, or fraudulent listings.

We may remove listings that fail these criteria and suspend users who repeatedly post them.

5. Prohibited conduct

While using niujom you may not:

  • Perform unauthorized scraping, mass indexing, or bot/automation-driven data extraction.
  • Attempt to bypass security, authentication, or rate-limit controls.
  • Impersonate another person, agent, or agency.
  • Discriminate against, harass, or threaten other users; communication must remain respectful.
  • Use the service for unlawful activities or money laundering.
  • Upload content that infringes third-party rights, is defamatory, or is unlawful.

6. Intellectual property

  • User content: you keep ownership of the photos, text, and other content you upload. By uploading it you grant us a worldwide, non-exclusive, royalty-free license to display, store, and distribute it within the platform and in related promotional communications.
  • Trademarks and design: the “niujom” name, the logo, the visual identity, the software, and the platform’s proprietary text are owned by ClearCore Labs and protected under applicable law.
  • If you believe content infringes your rights, write to legal@entuzona.io.

7. Third-party services and technology

niujom integrates with external services for some features (e.g., 3D tours, Instagram imports, USDT payments, maps). These services are governed by their own terms and policies. niujom is not responsible for their availability, quality, or behavior.

8. Payments, fees, and subscriptions

Some features (for example, agency plans or listing promotion) may require a subscription or fee. Applicable prices and conditions will be shown before any purchase. niujom does not participate in, mediate, or hold payments between users and agents arising from real estate transactions.

9. Limitation of liability

niujom is provided “as is” and “as available”. To the maximum extent permitted by law:

  • We do not warrant that the service will be error-free or uninterrupted.
  • We do not warrant the truthfulness, legality, quality, or safety of properties listed by third parties.
  • We are not responsible for negotiation outcomes, indirect damages, lost profits, or losses arising from transactions between users and agents.
  • All purchase, sale, rental, or investment decisions are solely the user’s, who should conduct their own due diligence and consult professionals (legal, financial, tax) where appropriate.

10. Indemnity

You agree to hold niujom and ClearCore Labs harmless against third-party claims arising from the content you publish, misuse of the platform, or breach of these Terms.

11. Suspension and termination

You may stop using niujom and delete your account at any time. We may suspend or close your account if you breach these Terms, if we detect fraudulent use, or if a competent authority requires it.

12. Changes

We may update these Terms from time to time. When we make material changes we will notify you by email or via a visible notice on the platform. Continued use after notice means you accept the new Terms.

13. Governing law and jurisdiction

These Terms are governed by the laws of the Bolivarian Republic of Venezuela. Any dispute will be submitted to the competent courts of Caracas, except where overriding law provides otherwise.

14. Privacy

Processing of personal data is governed by our Privacy Policy and our Cookie Policy.
